RULE 14.1                 COMPENSATION OF ARBITRATORS

(A) Manner of Appointment:

The judge assigned to the case shall appoint the arbitrator from a list of attorneys licensed to practice law in the State of Ohio maintained by the Court. If the parties elect to have a panel of arbitrators consisting of more than one arbitrator then the Court shall appoint the presiding arbitrator and the parties may then select up to two arbitrators. In the event of a panel of arbitrators the Court's appointee shall be the chief arbitrator.

(B) Compensation

(1) The arbitrator, or the chief arbitrator, named by the Court where a panel is needed, unless otherwise ordered by the Court, shall receive compensation for services rendered as set out below. The arbitrator’s fee shall be paid directly to the arbitrator and shall be paid within 14 days of the appointment of the arbitrator unless other wise set by the Court. Each party to the action shall deposit the sum of $175 with the arbitrator, unless otherwise set by the Court.

(2) When more than one case arising out of the same transaction is heard at the same hearing or hearings, it shall be considered as one case insofar as compensation is concerned.

(3) In cases requiring hearing of unusual duration or involving questions of unusual complexity, the Court, on motion of the arbitrator or chief arbitrator, may allow additional compensation.

(4). Where a panel of arbitrators is used the parties shall each pay the arbitrator they selected a sum equal to that paid to the court’s arbitrator.

(C) Settled Cases

(1) If the case is settled prior to arbitration hearing the arbitrator shall be entitled to a fee based upon actual time spent at a Sixty Dollar hourly rate for services rendered to review the case, schedule it for hearing and for the correspondence involved, to be billed equally to the parties and retained from the deposited fees. The balance shall be refunded to the parties.

(2) If the arbitrator or panel has heard the case then the arbitrator or panel shall be entitled to retain the fees entirely.
