A.  Any plaintiff who files a notice of voluntary dismissal pursuant to Civil Rule 41 (A)(1)(a) shall be responsible for all court costs incurred through the Clerk of Courts.

B.  Any dismissal filed pursuant to Civil Rule 41 (A)(1)(b) shall contain a stipulation as to who shall be responsible for court costs. In the absence of a stipulation, costs shall be taxed first to the deposit and then to plaintiff.

C.  In any case where a plaintiff files a notice of voluntary dismissal, where a counterclaim is filed, no costs shall be assessed until the counterclaim is disposed of.
